We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.

2. Description of Service

MagicMove AI provides a website migration service that:

• Analyzes and audits websites for performance, SEO, and other metrics
• Migrates websites from various platforms to Vercel hosting
• Optimizes and improves website performance during migration
• Provides preview functionality before finalizing migrations

3. Eligibility

You must be at least 18 years old or have reached the age of majority in your jurisdiction to use our Service. By using the Service, you represent and warrant that you meet these requirements.

4. User Responsibilities

By using our Service, you agree to:

• Only submit websites that you own or have authorization to migrate
• Provide accurate information when using the Service
• Not use the Service for any illegal or unauthorized purpose
• Not attempt to circumvent any security measures of the Service
• Not use the Service to migrate content that infringes on third-party rights
• Not use the Service to migrate malicious, harmful, or inappropriate content

5. Website Ownership and Rights

You represent and warrant that:

• You own or have the legal right to migrate the website(s) you submit
• You have all necessary rights to the content on your website
• The migration of your website does not violate any third-party rights
• Your website content complies with all applicable laws and regulations

After migration, you retain full ownership of your website content and the migrated files. We do not claim any ownership rights over your content.

6. Payment Terms

6.1 Pricing

Our Service is offered at a one-time fee of $20 USD for the "Migrate into Awesomeness" package. Prices are subject to change, but any price changes will not affect orders already placed.

6.2 Payment Processing

Payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms of service and privacy policy.

6.3 Refunds

We offer refunds on a case-by-case basis. If you are unsatisfied with your migration, please contact us at support@magicmove-ai.com within 30 days of purchase. Note that you can preview your migrated site before payment, so please review carefully before purchasing.

7. Service Availability

We strive to maintain high availability of our Service, but we do not guarantee uninterrupted access. We may:

• Temporarily suspend the Service for maintenance or updates
• Modify or discontinue features with or without notice
• Experience downtime due to factors beyond our control

We are not liable for any loss or damage resulting from Service interruptions.

8. Third-Party Services

Our Service integrates with third-party services including:

• Vercel: Your migrated website will be hosted on Vercel's infrastructure, subject to their terms of service.
• Stripe: Payment processing is handled by Stripe, subject to their terms.

We are not responsible for the actions, content, or policies of these third-party services. Your use of these services is subject to their respective terms and privacy policies.

9. Intellectual Property

The Service, including its design, features, and content (excluding user-submitted content), is owned by MagicMove AI and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our Service or its components
• Reverse engineer or attempt to extract source code
• Use our trademarks or branding without permission
• Create derivative works based on our Service

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• Migration results will be 100% identical to your original site
• Any errors in the Service will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGICMOVE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or alteration of your content
• Any third-party conduct or content on the Service
• Any issues with your migrated website on Vercel

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless MagicMove AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit for migration

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of the United States.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MagicMove AI regarding the Service and supersede all prior agreements and understandings.
